Rules, Restrictions and Disclaimers.

Acceptance and use by the recipient(s) of gift-card bonus offers by Liveware Publishing, Inc. (“Liveware”) are subject to and incorporate the rules and conditions below:

General Rules, Restrictions and Disclaimers

1) All bonus programs are available to US residents only. All offers are void where prohibited by law. Only R&R ReportWorks Infinity license (“R&R License”) purchases made directly through Liveware for the end-user licensee (“Purchaser”) are subject to the bonus programs. R&R License purchases from any other source including, but not limited to, resellers, OEM software publishers, third parties or distributors are not eligible for any gift-card or other bonus.

2) Use of all gift-cards issued under the RefeRRal (or other) bonus programs are subject to the issuers’ rules and restrictions as incorporated in their issuance. Please see the applicable issuer’s published materials for those rules and restrictions.

3) Liveware’s distribution as bonuses of the gift-cards does not in any way imply or represent an endorsement of Liveware’s products by those gift-cards’ issuers. Nor does Liveware endorse, warranty or take any responsibility, express or implied, in and for the products and services provided by the gift-cards’ issuers.

4) Liveware will not replace lost or stolen gift-cards, and is not responsible for any misuse or other violations of the gift-card issuers’ terms of use.

5) Liveware’s offer of a gift-card bonus shall not be construed as an invitation or inducement to the recipient(s) to violate any law, nor to violate any contractual agreement with any party (including, but not limited to, their employer who may have policies related to such bonus compensation). Further, Liveware makes no representation as to the taxability to various jurisdictions of the value of the gift-cards to the recipient(s).

6) The recipient(s) of the gift-card bonuses acknowledge that the offer is void and Liveware shall be held harmless if the recipients’ acceptance and use of the gift-cards violate any law, or the recipient(s) are not eligible. This provision applies whether Liveware has issued the gift-card(s) to the recipient(s) or not.

7) Liveware’s maximum liability in distributing any gift-card is the retail value of that gift-card. Under no circumstances shall Liveware be liable for special, incidental or consequential damages arising out of the distribution or use of any gift-card.

8) Liveware will not issue any gift-card bonus until the R&R License(s) are paid in full. Return or any other rejection of licenses authorized for refund by Liveware within the 30-day warranty period voids any bonus offer.

9) Liveware reserves the right to substitute other issuers’ gift-cards at its sole discretion and makes no assurance that the gift-card(s) requested by the recipient(s) will be available during the duration of this promotion. Liveware will make every effort to meet the recipients’ requested gift-card. Liveware also reserves the right to terminate this promotion at any time. Liveware may modify or terminate these offers at any time and at its sole discretion without notice.

Additional RefeRRal Program Rules:

10) Referral bonus for the referring party does not apply to the purchase of an R&R License Upgrade; such bonus applies only to newly issued R&R Licenses.

11) The Purchaser of the R&R License must present to Liveware at the time of purchase these items about the referring party:

            Recipient’s Name

            Company/organization name

            R&R serial number (of the referring party),

                        either 16-digit installation code or serial number on Report Designer

                        launch screen or user-management

12) Upon receipt of this information for a fully-paid R&R license by the Purchaser, Liveware will send to the Purchaser a form, either by mail or other carrier, or via email, wherein the Purchaser may identify the recipient for the Purchaser’s gift-card, and also (if applicable) the referring party’s gift-card recipient. Please allow 4-6 weeks for fulfillment of the gift-card bonus after the Purchaser has returned the completed form to Liveware. The Purchaser should retain a copy of the form in case any follow-up correspondence is required.

13) The Purchaser is responsible for obtaining the full correct mailing address and identity of both the Purchaser’s gift-card recipient and the referring party’s gift-card recipient.

14) The referring party may be another person within the Purchaser’s organization, provided that said organization already has a fully-paid R&R License. The referring party receiving the gift-card bonus cannot be the Purchaser or an immediate family member (spouse, child, parent, grandparent, etc.) of the Purchaser within the same organization. Note: This restriction does not exclude family members who work for a referring party with a fully-paid R&R License in a different organization.

15) A single license referring party is eligible for the bonus for multiple R&R Licenses from either a single Purchaser or multiple Purchasers.

16) The referring party may select a different gift-card bonus issuers than the Purchaser.
